These Terms of Service ("Terms") govern your access to and use of the APX platform operated by APX ("we," "us," or "our"). By using APX, you agree to be bound by these Terms.
By creating an account or using the APX platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.
APX is a business productivity platform for recruiting and staffing firms. You may use APX only for lawful business purposes. You agree not to:
APX provides tools to send outreach emails. You are solely responsible for ensuring your outreach complies with all applicable laws, including CAN-SPAM, CASL, and GDPR. APX includes built-in unsubscribe management, but it is your responsibility to honor opt-out requests and maintain suppression lists.
You are responsible for maintaining the security of your account credentials. Notify us immediately at apxats.com if you suspect unauthorized access. We are not liable for losses resulting from unauthorized account access due to your failure to maintain credential security.
You retain ownership of all data you enter into APX — candidates, clients, contacts, and communications. We do not claim any ownership over your data. You grant us a limited license to store and process your data solely to provide the APX service.
We strive for high availability but do not guarantee uninterrupted access to the platform. We reserve the right to perform maintenance, updates, and modifications at any time. We will provide advance notice for planned downtime where possible.
APX is billed monthly or annually per seat. Subscriptions automatically renew unless cancelled. You may cancel at any time from your account settings or by contacting us at apxats.com. Cancellations take effect at the end of the current billing period. We do not issue refunds for partial periods.
To the maximum extent permitted by law, APX shall not be liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to other users, third parties, or our platform. You may terminate your account at any time by contacting us.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of APX after changes constitutes acceptance.
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.
